One such landmark case saw Botha lead a multidisciplinary team through a Constitutional Court battle that secured 22% of Kumba Iron Ore’s mining rights, safeguarding billions of rands and altering the course of mining legislation in South Africa. In 2008, Botha led a successful arbitration at the International Chamber of Commerce, securing the mine’s tenure and averting financial losses in the billions. That same year, he navigated a high-stakes restructuring negotiation involving the potential retrenchment of 14,000 employees. Through persistent dialogue with unions and government over nine months, 7,000 jobs were saved without a single forced retrenchment. Not shying away from crisis, Botha also played a key role in labor court negotiations and strike management during a billion-rand equipment hijacking incident, once again showcasing his ability to manage complex legal and operational challenge.
