CHALLENGING MISCONCEPTIONS IN EMPLOYMENT LAW

Nowhere is the danger of ‘convenient flexibility’ more visible than in the enforcement of internal disciplinary procedures. A widespread misconception—often perpetuated by legal advisors—is that employers can bypass their own policies when convenient. Although the Labour Relations Act (LRA) Schedule 8 Code of Good Practice promotes procedural flexibility, it does not grant employers the right to ignore their internal disciplinary codes, especially when those codes are contractually binding.In multiple cases we’ve encountered, companies have brought in external legal counsel to prosecute internal hearings, even when policies explicitly exclude such representation for employees. This creates a legal and ethical imbalance that undermines the legitimacy of the entire process.

LEADERSHIP IS ABOUT CONSISTENCY AND ACCOUNTABILITY

Executives and managers are not exempt from the policies they enforce. Employment contracts often state clearly that all employees—regardless of rank—must comply with internal governance frameworks. Failure to do so isn’t just procedural sloppiness; it can amount to misconduct. If a policy bars legal representation in internal hearings, that rule must apply to everyone involved—management included. Bringing in external attorneys while denying the same to employees isn’t just inconsistent—it’s unfair and opens the door to legal challenge.
